What is a public record?
With a few exceptions, all government records of any kind are considered public records. This includes, but is not limited to, paper, electronic, microfilm and film.
Who can make a request for records?
The public has the right to inspect and copy certain public records. The law also states that certain records are confidential and therefore exempt from public disclosure.
Can Clatsop County charge people for copies of public records?
Yes, public agencies may charge a fee to recover the costs of fulfilling a records request. We will send you an invoice for the estimated fees. Upon payment, work will begin on fulfilling your request.
Are fees ever waived?
Yes, fees are sometimes waived or reduced if doing so is in the public interest.
How can I reduce the potential cost of my public records request?
Each request is different but here are some suggestions.
- Be as specific as possible with your request.
- Include a start and end date for the requested records.
- Include keywords that can be used in the search for documents.
Will my document have redactions?
A redaction is when some of the requested records have information that is blacked out. Depending on the type of request or who is requesting the record, the results may have redactions in accordance with state law.
Is there a difference in public records and Freedom of Information Act (FOIA) requests?
Yes, although state public records law is similar to the federal FOIA in some ways, they are separate laws with different provisions. For information about seeking records from the federal government, go to the Reporters Committee for Freedom of the Press.
